Pakistan Environmental Protection Act, 1997
Pakistan’s environmental policy is built on a team effort to achieve sustainable growth through strong legal and technical institutions. The Federal Environment Ministry was born in 1975, leading to the 1983 Ordinance, the country’s first major environmental law. This set up the first EPA offices. Pakistan pledged to worldwide standards following the 1992 Earth Summit and established the National Conservation Strategy (NCS). The original regulation was finally replaced by PEPA of 1997. It sets up environmental courts, manages renewable resources, and provides the rules for species protection.
Pakistan Environmental Protection Council
This is the top environmental body in the country. It was first started in 1984 and is now headed by the Prime Minister of Pakistan. The council includes members from the business world, NGOs, universities, and the media, along with government experts.
Pakistan Environmental Protection Agency (Pak-EPA)
Established in 1993, Pak-EPA started small but grew quickly. It set the standards for factory waste, car exhaust, and noise levels. Today, it is the technical arm of the Ministry of Environment.
Key Functions and Powers
- Inquiries: The agency can investigate environmental issues on its own or if someone complains.
- Summons: It can force people to attend meetings and provide documents for an investigation.
- Inspections: With a warrant, officials can enter and search buildings or vehicles if they believe a crime against nature is happening.
Provincial Environmental Protection Agencies
Every province in Pakistan has its own EPA created under the 1997 Act. The Federal Government has shared its powers with these provincial offices to ensure local environmental issues are handled quickly.
Initial Environmental Examination (IEE) and Environmental Impact Assessment (EIA)
Builders need to assess the environmental hazards before starting a new project. Under Section 12, you must submit an IEE (for tiny hazards) or an EIA (for bigger risks) and get EPA approval before beginning construction.
Hazardous Waste and Motor Vehicles
- Hazardous Waste: The law bans the import of toxic, explosive, or flammable substances that could harm the environment.
- Motor Vehicles: It is illegal to drive a car that is too noisy or smoky. The EPA can force you to install pollution control devices or use specific fuels to meet safety standards.
Environmental Tribunals and Magistrates
To hear legal matters, the government has created four Environmental Tribunals, one in each province. Moreover, serving as Environmental Magistrates, senior civil judges handle relatively minor offences such as vehicle pollution or improper handling of dangerous chemicals.
Penalties and Power
Environmental Magistrates can:
- Award money to victims for their losses.
- Send offenders to jail for up to two years.
- Order a factory to close down.
- Seize machinery, vehicles, or documents involved in the crime.
National Environment Policy
This policy offers a broad strategy for tackling Pakistan’s environmental issues, including waste management, smog, and water contamination. It advises all forms of government, from local to federal, on how to handle resources properly.
