An apostille is an additional authentication that verifies the authenticity of a signature, stamp, or seal on a document. The document’s content is not vetted by it. The document is legally recognised for use in countries that are members of the Hague Convention, rather than vice versa.

An apostille ensures that a document signed and notarised in Pakistan will be accepted and valid in any country that is part of the Hague Convention of 1961.

Public documents that are intended for use in countries bound by the Hague Convention 1961 receive an apostille, which is a type of special certification. The document is endorsed by a designated authority in the country where it is issued and is accepted by all other convention member countries.

The competent authority in the country where the document is issued attaches an apostille, which is essentially a certificate. The certificate verifies that the signature, the person who signed the documents, and any stamp or seal on the document are authentic.

This procedure in Pakistan is managed by the Ministry of Foreign Affairs (MOFA). After completing the necessary requirements and steps, an Apostille in Pakistan will be initiated within several months. Until then, the MOFA will maintain its customary legal procedures.

However, as a member state of the Convention, Pakistani concerned authorities have agreed to accept Foreign Apostille & Notarization Certificates from other member states without having to attest to them from their respective MOFA or Pakistan-based counterparts abroad.

To ensure legal compliance and prevent fraudulent activities, a document is notarised by obtaining certification from reputable Notary Publics who verify and authenticate its signatures. An individual who is not an official legal professional and has government certification to observe and verify the signatures on documents is referred to as a Notary Public.

In this process, the Notary Public is responsible for verifying that whoever signs their document is legitimate.’ The Notary Public ensures that the person signing the document is voluntary and not under any pressure. The Notary Public, upon satisfaction, adds the official seal and signature to authenticate the document’s authenticity and the claimant’s.

Notarised documents in Pakistan can vary depending on the document type, but typically include affidavits, power of attorneys, and contracts. Documents that are legally or officially required to be notarised are usually only used as a form of document.

To be clear, notarization is a process that operates separately from legalisation. Please clarify this fact. While notarization is the sole way to ensure the document’s authenticity and signature, legalisation is a prerequisite for international use of documents. Both formal and informal signing are necessary.
