Filiation is not a legal form of child adoption, but the guardian’s rights and responsibilities are permanently transferred from the biological parent or parents through this process.

Child Adoption & Guardianship Process in Pakistan
If courts revoke parents’ rights, children are put in foster care and subsequently placed under state guardianship. The department is committed to identifying permanent homes for all children under country guardianship, with a preference for adoption. Adoption is also available.
The procedure for adopting a child with state guardianship is:
A court grants parental rights and assigns the child to guardianship;
The court agency finds the best family for a child; and
The creation of a new family is assisted by private adoption agencies, such as Edhi Foundation, and
The courtfinalisess the adoption under the Guardians & Wards Act.
SARDAR KHAN & CO offers legal advice, representation, and assistance for identified, interstate, or family adoptions. We support adoptive parents in completing all legal requirements, such as preparing the Adoption Deed and submitting a Petition for Guardianship to the appropriate Court of law, as well as applying for leave to take the child into custody outside of the Court.

Creating adoption plans for adoptive parents who have identified the family or birth mother, intending to abandon their child;
Giving birth parents’ medical details and background information to adoptive parents.
Obtaining the pregnancy records of the birth mother and sending them to a doctor of their choice;
Adoption upon the newborn child’s discharge;
Compliance with Interstate Compact requirements (where the parents of adoptive children live outside Pakistan). and
offering all necessary legal support to terminate the parental rights of the birth parents and finalise the adoption by a Pakistani Court.
